Terms of Service

These Terms of Service ("Terms") govern your use of the website at www.leraefar.shop (the "Site") operated by LERAE FARMS, LLC ("Lerae Farms," "we," "us"), a Utah limited liability company at 12800 N 1200 E, Lewiston, UT 84320. By browsing the Site or submitting an inquiry, you accept these Terms. If you do not agree, do not use the Site.

1. What This Site Is

The Site is an informational brochure for an operating farm: it describes our parcels, varieties, field practices and how to reach the grower's desk. It is not an online store, auction, exchange or marketplace. Nothing on the Site constitutes an offer to sell any product; quotations and contracts are issued only in writing after a reservation inquiry is evaluated.

2. No Contract by Browsing

Viewing a variety, submitting the crop reservation slip, or exchanging messages with the desk opens an inquiry — not a purchase contract, acreage commitment or allocation. A binding agreement arises only when both parties execute written terms covering variety, volume, quality, price, delivery and compliance conditions. We may decline any inquiry at our discretion, including where licensing, season or supply does not support it.

3. Informational Content Only

Descriptions of crops, parcels, practices and markets are general information, not agronomic, legal, tax, financial or medical advice. Growing conditions, yields and prices vary by season and place; decisions about cultivation, purchasing or compliance should be made with your own advisers and, where applicable, your own agronomist, attorney or licensing consultant.

4. Regulated Crops — Read This Carefully

  • Hemp, cannabis and marijuana (V-28–V-30): these varieties are cultivated only under valid state licenses, with required THC testing, registered acreage, compliant transport and licensed buyer channels — and only in jurisdictions where open-field cultivation is lawful. The Site's mention of these crops is a description of our licensed scope, not an offer to sell controlled substances or to ship into any jurisdiction where they are unlawful.
  • Buyer's burden: it is your responsibility to know and obey the laws of your state and destination, to hold the licenses your purchase requires, and to not request products, documentation or transport that would violate any law.
  • Tobacco and specialty crops: sales follow applicable marketing, tax and age-restriction rules. We do not sell regulated products to consumers.
  • No authorization by website: this Site grants no license, permit or authorization of any kind. Nothing here should be read as encouraging unlawful cultivation, possession or sale.

5. Agricultural Realities

Farming is seasonal and weather-exposed. Availability, volumes, quality grades and harvest windows described on the Site are estimates, not guarantees. A reserved crop may be shortened or lost to frost, drought, pests or water allocation; when that happens we communicate early and offer alternatives, but we are not liable for the season's terms. Test results, purity and certifications apply only to the specific lot and date they describe.

6. Acceptable Use

You agree not to: scrape or bulk-harvest the Site's content; probe, scan or attack the Site or its hosting; submit false, misleading or unlawful inquiries (including inquiries about controlled crops from unlicensed or unlawful channels); misrepresent your identity, license status or authority; or use the Site in any way that violates applicable law. We may block access and report unlawful conduct.

7. Intellectual Property

The Site's text, layout, illustrations (including the seed-packet artwork and plat diagrams), branding and the "Seed Packet" design system are the property of LERAE FARMS, LLC or its developer and are protected by copyright and other laws. You may view and share links to the Site; you may not reproduce, republish or adapt its content or artwork without written permission.

8. Third-Party Links & Services

The Site may link to third-party sites or rely on third-party infrastructure (hosting, fonts). We do not control and are not responsible for third-party content, policies or availability. Following a link is at your own discretion.

9. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that any variety, volume or season will be available as described.

10. Limitation of Liability

To the maximum extent permitted by law, LERAE FARMS, LLC and its members, managers, employees and developer are not liable for indirect, incidental, consequential, special or punitive damages — including lost profits, lost crops, lost contracts or business interruption — arising from or related to use of the Site or reliance on its content. Our total aggregate liability for claims arising from the Site shall not exceed one hundred U.S. dollars (US$100). Nothing in this section limits liability that cannot be limited by law.

11. Indemnification

You agree to defend, indemnify and hold harmless LERAE FARMS, LLC from claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your breach of applicable law — including unlawful requests relating to regulated crops.

12. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, and by applicable U.S. federal law. Subject-matter rules specific to agricultural products, licensing and transport apply as written, and nothing here overrides them.

13. Disputes

Any dispute arising from the Site or these Terms shall be brought exclusively in the state or federal courts located in or covering Cache County, Utah, and you consent to their jurisdiction. Before filing, the parties will attempt good-faith resolution through the grower's desk for at least thirty days. Any claim must be brought within one year after it accrues or is barred.

14. Severability, Waiver & Changes

If a provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. We may update these Terms; the current version is posted here and material changes take effect on posting unless stated otherwise.
